Privacy & Security Policy

This policy explains how Marie Borders, Real Estate Associate (DRE #01256719) with Marin’s Finest (“we”, “us”), collects, uses, shares and protects information through marieborders.com (the “Site”). It also describes how we handle multiple listing service (MLS) data displayed on the Site. By using the Site you agree to this policy.

1. Information we collect

Information you give us

We only collect personal information that you choose to send us through a form on the Site:

• Contact and listing enquiries: name, email address, phone number, subject and message, and the listing you asked about, if any.
• Home value requests: property address, property details (bedrooms, bathrooms, square footage, year built, condition), your selling timeline, notes, and your name, email and phone.
• Wish list: name, email and phone; preferred neighborhoods, must-have and nice-to-have features, bedrooms, bathrooms, budget and timeline; and, if you choose to tell us, household size, preferred school district, whether there are children or pets in the home, and notes.
• Guide downloads: name, email, phone, which guide(s) you asked for, and whether you would like to hear from us about the market.
• Open house RSVPs: name, email, phone, number of guests, whether you are working with an agent or are pre-approved, notes, and the open house you plan to attend.

Please don’t send sensitive information such as Social Security numbers, bank or account details, or wiring information through the Site. We will never ask for wire instructions by email or through this Site.

Information collected automatically

To learn which pages are useful, the Site keeps anonymous, aggregate counts: the number of page views and visits per day, which pages and listings were viewed, the name of the website that referred you (for example “google”), and whether you used a phone or a desktop screen. These counts are totals only. They do not include your IP address, location, name or any identifier, and they cannot be linked to you.

We do not use Google Analytics, advertising pixels, tracking cookies, fingerprinting, or third-party ad networks.

Cookies and browser storage

The Site does not set cookies. It uses your browser’s own storage for a few conveniences that stay on your device:

• Accessibility preferences you choose (such as text size or contrast), so they are remembered next time.
• A draft of the Wish List form, so you don’t lose your answers if you leave the page. It is cleared when you submit the form, and you can remove it at any time by clearing your browser’s site data.
• A short-lived “already counted” flag for the current browser tab, so one visit is not counted twice. It is deleted when you close the tab.
• A local cache that lets published listings load faster.

Do Not Track: because the Site does not track you across websites, it behaves the same whether or not your browser sends a Do Not Track signal.

2. How we use your information

• To answer your enquiry, prepare a home valuation, search for homes that match your wish list, send the guides you request, and confirm your open house RSVP.
• To send you an automatic confirmation email when you submit a form.
• If, and only if, you tick the box to hear from us, to send occasional market updates. You can stop these at any time (see Section 6).
• To keep the Site secure and working properly, and to meet our legal and professional obligations as a licensed real estate agent.

3. How we share your information

We do not sell, rent or trade your personal information, and we do not share it for advertising. We share it only as follows:

• With our team: form submissions go to Marie Borders and her team assistant so they can respond to you.
• With service providers who run the Site for us: Google Firebase (secure database, file storage and server functions, hosted in the United States) and Resend (email delivery for form notifications and confirmations). The Site itself is hosted on GitHub Pages, and fonts are loaded from Google Fonts. These providers may only process information to deliver their service to us.
• With our brokerage, where required by law or professional rules, for example for record keeping on a transaction you take part in.
• When the law requires it, or to protect the rights, property or safety of you, us or others.

4. MLS listing data

Some property listings shown on the Site may come from the Bay Area Real Estate Information Services, Inc. (BAREIS) MLS under a data license. Where MLS data is shown:

• It is provided for consumers’ personal, non-commercial use, only to identify properties they may be interested in buying. It may not be used for any other purpose.
• We display only listings and fields that the listing broker and the MLS permit to be shown on the internet, and we honour all display restrictions (such as a seller’s choice not to show an address or photos).
• Information is deemed reliable but is not guaranteed and should be independently verified.
• Searching MLS listings on the Site does not require you to give us any personal information. Your search filters are used only to fetch matching listings and are not stored with any information about you.

5. How we protect information

We use reasonable administrative, technical and physical safeguards appropriate to a small real estate business, including:

• Encryption in transit: the whole Site is served only over HTTPS. Data sent to our database and email provider is encrypted in transit, and our providers encrypt it at rest.
• Restricted access: form submissions can be read only by signed-in team members. Visitors can submit a form but can never read, change or delete anyone’s submission, including their own. Database security rules enforce this on the server and deny everything that is not explicitly allowed.
• Protected credentials: passwords, API keys and MLS access tokens are never placed in the Site’s public code. MLS data is fetched through our own secure server function. The MLS access token is held in Google Secret Manager and is never sent to a visitor’s browser.
• Limited MLS access: our server function forwards only approved search requests to the MLS provider, limits how many results can be returned at once, and serves MLS data only to the Site. MLS data is used only to display listings on this Site. It is not resold, redistributed or combined into other products.
• Data minimisation: we collect only what each form needs, and our visit counts are anonymous by design.

No website or internet transmission can be guaranteed to be completely secure. If we learn of a security incident affecting your personal information, we will notify you and any required authorities as required by California law. To report a security concern, email marie@marinsfinest.com.

6. Your choices and rights

• Marketing emails: to stop receiving market updates, reply “unsubscribe” to any email from us or contact us using the details below, and we will remove you promptly.
• Access, correction and deletion: you may ask to see the personal information we hold about you, correct it, or have it deleted. We will respond within 45 days, unless we must keep a record by law, for example for a completed real estate transaction.
• California residents: California law gives you the right to know what personal information we collect and how we share it, to request deletion or correction, and not to be discriminated against for using these rights. We do not sell or share personal information for cross-context behavioural advertising, and we do not use or disclose sensitive personal information for any purpose beyond responding to your request.

7. How long we keep information

We keep enquiry information for as long as it is needed to respond to you and to keep up any ongoing working relationship. We keep transaction records for as long as real estate law and our brokerage require. After that, or when you ask us to, we delete it.

8. Children

The Site is intended for adults. We do not knowingly collect personal information from children under 16. If you believe a child has sent us information, please contact us and we will delete it.

9. Other websites

The Site links to other websites, such as our brokerage’s site. Their privacy practices are their own, and we encourage you to read their policies.

10. Changes to this policy

We may update this policy from time to time. When we do, we will post the new version on this page and change the “Last updated” date above. Significant changes will be highlighted on this page.
